These Terms & Conditions ("Terms") govern your access to and use of AivaFleet’s website, dashboard, mobile applications, and related services (collectively, the "Services"). By creating an account, booking a demo, or otherwise using the Services, you agree to be bound by these Terms.
If you are using the Services on behalf of a company or organization, you confirm that you have the authority to accept these Terms on its behalf.
2. Accounts & Eligibility
To use most features of AivaFleet, you’ll need an account.
- You must provide accurate, current information when creating an account.
- You’re responsible for keeping your login credentials secure and for all activity under your account.
- You must be legally authorized to operate or manage the vehicles/fleet you register on the platform.
- Notify us immediately if you suspect unauthorized use of your account.
3. Use of the Services
AivaFleet provides GPS tracking, driver management, analytics, and related tools for fleet operators through our web dashboard and the AivaFleet Vehicle and AivaFleet Driver mobile apps.
- You may use the Services only for lawful fleet management, tracking, and business purposes.
- You are responsible for the accuracy of the data you input (driver details, vehicle info, routes, etc.).
- Tracking accuracy depends on GPS signal, network connectivity, and device conditions, which are outside our control.
4. Subscriptions, Trials & Payment
Access to paid features requires an active subscription. Pricing, billing cycles, and included features are described on our Pricing page or in your service agreement.
Fees are billed in advance and are non-refundable except where required by law. We may suspend or downgrade access for accounts with overdue payments after reasonable notice.
5. Devices & Hardware
Where AivaFleet supplies GPS trackers or other hardware, that equipment remains subject to any separate hardware terms provided at installation, including warranty limitations and replacement policies for damaged or lost devices.
6. Acceptable Use
You agree not to:
- Use the Services to track any vehicle or individual without proper authorization or legal basis.
- Attempt to reverse-engineer, decompile, or interfere with the platform’s security or infrastructure.
- Resell, sublicense, or provide third-party access to the Services without our written consent.
- Upload harmful code, spam, or misuse the contact and support channels.
7. Intellectual Property
AivaFleet, its logo, dashboard, mobile apps, and underlying software are owned by AivaFleet and protected by intellectual property laws. These Terms don’t grant you any ownership rights — only a limited, non-transferable license to use the Services as intended.
8. Termination
You may stop using the Services and close your account at any time. We may suspend or terminate accounts that violate these Terms, pose a security risk, or have significantly overdue payments. Upon termination, your right to access the Services ends, though certain data retention obligations may still apply.
9. Disclaimers & Limitation of Liability
The Services are provided "as is." While we work hard to keep tracking data accurate and the platform available, we don’t guarantee uninterrupted or error-free service, and we’re not liable for issues arising from GPS/network limitations, third-party integrations, or misuse of the Services.
To the extent permitted by law, AivaFleet’s total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months preceding the claim.
10. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where your AivaFleet account is registered, without regard to conflict-of-law principles.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services or for legal reasons. We’ll post the updated version on this page with a revised "last updated" date. Continued use of the Services after changes take effect means you accept the updated Terms.
